Terms of Service

These Terms of Service ("Terms") govern your use of thefortnh.com (the "Site") and the fitness, cycling, and related services operated by The Fort NH ("The Fort," "we," "us"). By using the Site or any of our services, you agree to these Terms.
1. Who we are
The Fort operates Fortitude Training and FortCycle at 775 Canal Street, Manchester, NH 03101. Performance Therapy, led by Dr. Molly Sifflard, DPT, is a separate limited liability company that provides physical therapy at the same location. When you book physical therapy, your relationship is with Performance Therapy, which has its own intake paperwork, patient consent forms, and billing practices.
2. Use of the Site
You may use the Site for personal, non-commercial purposes related to learning about and engaging with our services. You agree not to:
- Use the Site for any unlawful purpose.
- Attempt to access areas of the Site you're not authorized to use (for example, the admin dashboard or other members' accounts).
- Copy, scrape, or republish our content without written permission.
- Interfere with the Site's operation, including by uploading harmful code.
3. Memberships, classes, and billing
Memberships, class packs, and session bundles for Fortitude Training and FortCycle are sold and billed through MindBody. When you sign up, you agree to MindBody's own terms and to the specific membership terms shown to you at checkout (including pricing, renewal schedule, and cancellation rules). The Fort is not responsible for technical issues with MindBody, though we'll help you work through them.
Thrive programs are sold as a 6-week cycle. Unless stated otherwise in writing, enrollment is non-refundable once the cycle has begun. If you need to pause for a medical reason, contact us.
4. Fitness waiver and assumption of risk
Exercise carries inherent risk of injury. Before participating in any Fortitude Training, FortCycle, or group fitness program at The Fort, you'll be asked to sign a waiver and assumption-of-risk form confirming that you understand those risks. That signed waiver is separate from these Terms and continues to apply whenever you participate.
You agree to disclose any health conditions that could affect your participation and to follow reasonable instructions from our staff.
5. Medical disclaimer
Content on the Site — including blog posts, educational snippets in the Journey quiz, and chat responses from our AI guide — is for informational and educational purposes. It is not medical advice and is not a substitute for care from a qualified healthcare provider. If you have a medical condition, consult a licensed professional before beginning any exercise program.
Physical therapy services are provided separately by Performance Therapy, PLLC under Dr. Molly Sifflard, DPT, and are subject to that practice's own clinical and administrative policies.
6. Accounts
If you create a member account on the Site, you're responsible for keeping your password confidential and for activity under your account. Let us know immediately if you suspect unauthorized use. We may suspend or close accounts that violate these Terms or that appear to be misused.
7. Intellectual property
The Site, our logos ("The Fort," "Fortitude," "FortCycle," "Thrive," "Performance Therapy"), photographs, program content, and written material are owned by The Fort or our licensors. Nothing in these Terms gives you a license to use them beyond ordinary, personal use of the Site.
8. Your content
If you submit information through forms, upload a photo, or leave a testimonial, you give The Fort permission to use that information to respond to you and, where appropriate, to share with our team members. If you submit a testimonial or review, we may share it on the Site with your first name. If you want a testimonial removed, email us and we'll take it down.
9. Third-party services
The Site links to or integrates with third-party services like MindBody, Google Maps, Instagram, and Facebook. Those services are operated by others and are subject to their own terms and privacy policies.
10. Limitation of liability
To the fullest extent allowed by New Hampshire law, The Fort, its owners, employees, and contractors are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or our services. Our total liability, if any, is limited to the amount you paid us in the six months before the claim arose. This section does not limit any liability that cannot be limited under law.
Nothing in these Terms replaces or limits the specific waiver you signed before participating in physical training at The Fort.
11. Indemnification
You agree to reimburse The Fort for losses or costs arising from your misuse of the Site, your violation of these Terms, or your violation of someone else's rights while using the Site.
12. Governing law
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. Any dispute that isn't resolved informally will be brought in the state or federal courts located in Hillsborough County, New Hampshire, and you agree to personal jurisdiction there.
13. Changes
We may update these Terms from time to time. The "Last updated" date at the top of this page shows the most recent change. Continued use of the Site after an update means you accept the new Terms.
